Know Your Constitutional Rights
If you have been charged with a DUI, make sure that your rights are protected.
Your rights are:
  • To be issued a Miranda warning. " If given a custodial interview."
  • To be informed that the field sobriety tests are optional.
  • To request a blood test.
The Government must:
  • Prove that they have reasonable suspicion to pull you over
  • Prove that they have probable cause to arrest for a DUI
  • Prove that the officer followed the proper procedures

  • Horizontal gaze nystagmus tests.
  • Walk and turn test.
